Alla luce della Legge 132/2025: tra tutela, eccezioni e innovazione 

English abstract

Italy positioned itself among the first countries in the world to adopt national legislation on AI. Law 132/2025 represents a turning point for Italian libraries, harmonizing national legislation with the European AI Act and balancing technological innovation with the protection of rights. The law redefines the concept of creativity, distinguishing between human contribution and automatic generation, and connects with Legislative Decree 177/2021 that transposed the exceptions for text and data mining introduced by EU Directive 2019/790 on copyright in the digital single market. It also establishes principles of responsibility, transparency, and training for the professional adoption of artificial intelligence. For libraries, this allows the development of innovative digital services by leveraging AI in cataloging, semantic indexing, heritage valorization, and content accessibility, while ensuring the protection of works and sensitive data. The law thus provides a clear regulatory framework for combining technology and the cultural mission of libraries.
